Please read this carefully. By using our website or submitting an order (and any subsequent orders) on this web site you are agreeing to the terms that appear below.

You agree to purchase services and goods from Ruxley Manor subject to these Terms and Conditions which will apply to all transactions using ruxley-manor.co.uk.

You must be 18 years or over and to participate in the Ruxley Manor online order service.

Your email address is essential in order for us to be able to supply you with important information such as Order Confirmations, and changes to the service. By registering or ordering with ruxley-manor.co.uk, you accept that your email address may be used to supply you with such information.

Equally, your mobile phone number will be requested during your checkout process. We will only ever use this to contact you about your order and will be passed on only to our courier partner for the same reason.

1 – WAIVER

Every effort has, is and will be taken to ensure that the information contained in this site is correct and up to date. The information may from time-to-time become incomplete, inaccurate or out of date. To the full extent permitted by law, but subject to the terms and conditions of sale referred to below, we disclaim all warranties and representations (whether implied or expressed) as to the accuracy of any information contained on this Site

2 – DEFINITIONS & INTERPRETATIONS

2.1a With the exception of goods referred to in clause 2.1(b), the price of the goods will be as quoted on the web site at the time you confirm your order subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged will be those applicable to the new item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

Contract: the contract for the sale and the purchase of the Goods. Acceptance of completion of the contract between you and us will take place on the despatch to you of the Goods ordered (unless we have notified you that we do not accept your order).

Goods: the range of plants or any products available for purchase from our website in accordance with the terms

3 – BASIS OF THE SALE

3.1 An agreement for us to sell you Goods is made on these terms when we accept an order made by you via our website. The description of the Goods, the price, the VAT, insurance and delivery costs are set out in the order page. We will confirm acceptance of your order on-screen.

3.2 We aim to give you a clear idea of the nature of the products we sell. Illustrations, descriptions, and other information are approximate and for guidance only.

4 – DETAILS OF THE ORDER

4.1 Quantity, quality and description of the Goods will be those set out in your order (if accepted by us)

4.2 Orders are accepted at our sole discretion but are normally accepted of the Goods are available, the order reflects current pricing, you are based in the Delivery area and your credit or debit card is authorized for transaction.

5 – PRICE OF THE GOODS

5.1 Our charges for transport, packaging and insurance will all be included in the total for the Goods at the order confirmation page.

5.2 All prices quoted are British pounds (£) and include Value Added Tax (VAT)

5.3 Whilst prices displayed on the website are generally correct, we reserve the right to cancel orders where pricing is obviously wrong due to system errors.

6 – PAYMENT TERMS

6.1 Your credit/debit card account will be charged upon receipt of your order. We do not accept liability if a delivery is delayed because you did not give us the right payment details.

6.2 We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorized access to any data, including credit and account details you provide when accessing or ordering from this website, unless this is solely due to our negligence.

7 – DELIVERY

7.1 We will deliver the Goods to the address that you specify in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any loss or damage to the Goods once they have been delivered in accordance with your delivery instructions.

7.2 We will aim to deliver the Goods by the date quoted for delivery, but delivery periods are not guaranteed.

8 – RISK AND OWNERSHIP

8.1 You will own the Goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

10 – WARRANTIES

10.1 We aim to deliver goods of the highest quality. Where the Goods are products we warrant that they will meet their specification.

11 – LIABILITY

11.1 If you have a valid claim in respect of the goods which is based on any defect in their quality or condition or their failure to meet specification in accordance with the Contract, and you have returned the Goods within 28 days of receipt, you will be entitled to choose either a refund or replacement goods free of charge.

11.2 These terms and conditions do not affect your statutory rights as a consumer.

11.3 Pictures on the website are generally accurate but variations in shape, size and colour must be expected.

12 – MATTERS OUT OF CONTROL

12.1 We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.

13 – COPYRIGHT

13.1 All of the written, photographic, design, video and audio content of the website together with the selection and arrangement of it and all software compilations are our copyrighted property or that of the people who have granted to us the right to use it and is protected as such. All rights reserved.

13.2 None of this material may be used without our written permission. You may download or print a single copy for your own non-commercial off-line viewing.

13.3 All names, logos, slogans, or other phrases may be a trade mark of ours or another person or corporation. Any unauthorized use of trademark is illegal.

15.1 We reserve the right to make changes to this website and these terms at any time. Please ensure that you read these terms and conditions every time that you use the site.

16 – GENERAL

16.1 Emails to you will be sent to the address you specify to us. You must only provide us with a valid email address and it is your responsibility to inform us of any changes to that address.

16.2 To the extent that any provision of these terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, in any jurisdiction, that provision will be deemed not to be a part of these terms, it will not affect the enforceability of the remainder of these terms nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.

16.3 The headings in these terms are for convenience only and will not affect their interpretation.

17 – TICKETS AND EVENT BOOKINGS

17.1 –  Tickets are only valid for the date printed on the ticket, cannot be exchanged once booked and are non-refundable and non-transferable.

17.2 – Tickets (either printed or digital) must be presented on arrival. If you have not been able to print your ticket or are unable to present your ticket on your mobile device, please bring your booking reference with you at least 10 minutes before the start of your event so that we can validate your booking.

17.3 – If for any reason in these Terms and Conditions we refuse to accept a ticket, it is also non-refundable.

17.4 – If tickets are purchased on behalf of others, the purchaser accepts these Terms & Conditions will apply to each person they book for.

17.5 – Disabled parking, accessible toilets, and baby change facilities are available on site.

17.6 – Smoking is prohibited during your ticketed event (including e-cigarettes)

17.7 – For Events which include food and drink, we reserve the right, to change food/drink service times and change the food/drink offering to reflect seasonal variations.

17.8 – If for any reason we have to close and cancel the event, we may offer replacement tickets for an alternative day, or (at our discretion) a full refund.

17.9 – We reserve the right to exclude anyone from the premises whose behaviour is improper and which may affect the enjoyment or safety of our other guests and staff, without the right to a refund.

18 – THE MULBERRY RESTAURANT

18.1 – The Mulberry Tree Restaurant at Ruxley Manor Garden Centre, the Sip & Scoop and the Ice Café are not allergy free. Although your chosen food or drink may not contain an allergen, it may still be present in the tools we use or the environment. If you have an allergy, please let us know. We have detailed allergen information that we will go through with you so you can make an informed decision.

19 – GIFT CARDS

19.1 – Gift Cards can only be redeemed at Ruxley Manor and can be exchanged for goods of a higher price than the value on the card if the difference is paid by other means.

19.2 – The balance on a gift cannot be exchanged for cash and no change will be given where the value of a purchase is lower than the value of the gift card. The balance of the gift card can be applied to future purchases.

19.3 – Where goods are exchanged for good of a lower value the monies owing will be provided on another gift card.

19.4 – Gift cards are exempt from Ruxley Manor’s standard returns policy.

19.5 – The minimum amount required to activate a gift card is £1.00 and the maximum limit is £500.00

19.6 – Ruxley Manor does not accept any liability for lost, stolen or damaged cards.

19.7 – Ruxley Manor reserves the right to change these terms and conditions at any time.

19.8 – HTA Gift Cards can only be purchased with cash, debit or credit card. We cannot accept payment via Ruxley Manor Gift Cards or Credit Notes for HTA Vouchers.

20 – DIGITAL GIFT CARDS

20.1 – All above Terms from Term 19 also apply to Digital Gift Cards.

20.2 – Digital Gift Cards can only be sent to the purchasers email address.

20.3 – You can forward a Digital Gift Card to another recipient. Ruxley Manor accepts no responsibility if this communication is interrupted or appropriated.

20.4 – Digital Gift Cards can be emailed anywhere in the world, but must be redeemed physically instore or through the Ruxley Manor website. Please note, if redeeming online, all current delivery terms, availability and location restrictions apply.

21 – SOCIAL MEDIA COMPETITION TERMS AND CONDITIONS

21.1 – The promoter is: Ruxley Manor Garden Centre.

21.2 – Employees of Ruxley Manor Garden Centres or their family members shall not be permitted to enter the competition.

21.3 – There is no entry fee and no purchase necessary to enter any of our competitions.

21.4 – Entries can be posted on Facebook or Instagram or by sending the answer via our website. One entry per person.

21.5 – Closing date for entry is stated on Ruxley Manor Garden Centres Facebook pages. After this date, no further entries to the competition will be permitted.

21.6 – No responsibility can be accepted for entries not received for whatever reason.

21.7 – The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.

21.8 – No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and Ruxley Manor reserve the right to substitute any prize with another of equivalent value without giving notice.

21.9 – Winners will be chosen by an independent adjudicator appointed by the Promoter.

21.10 – The winner will be notified via Facebook within 7 days after the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

21.11 – The promoter will notify the winner when and where the prize can be collected.

21.12 – By entering this competition, an entrant is indicating his/her agreement to be bound by these specific Terms and Conditions.

By joining the Ruxley Manor Club loyalty program, we will collect and use personal information about you in accordance with data protection legislation and our Privacy Policy. This personal information includes your registration details, information about the use of your Loyalty Card, shopping purchases and other information that you give us. It will be used to administer the loyalty program, provide you with benefits, personalising your offers and to keep you updated with our latest news.

By joining the Ruxley Manor Club loyalty program, you agree to receive email and postal updates from us about the loyalty scheme, Ruxley Manor Garden Centre and your benefits. To opt out of receiving such updates you can terminate your membership by emailing theclub@ruxley-manor.co.uk

1. Introduction

a. Our loyalty program rewards members with points on instore and online purchases excluding the purchase of gift card vouchers, event tickets, alcohol and gas. To collect points on online purchases, customers must have already created an account and log into this account when purchasing online. Points will be converted into money saving vouchers by Ruxley Manor, to be redeemed at set times during the year. These vouchers will have a minimum expiry date of one month from date of issue and can only be redeemed instore at Ruxley Manor Garden Centre.

b. These terms and conditions set out the terms on which you can join the loyalty program, earn points and when these points are converted into reward vouchers to spend instore at Ruxley Manor at set times. These are also the terms relating to data protection.

c. If you join the loyalty program, you automatically accept these conditions.

2. Joining the loyalty program

a. Your name, full postal address, email address, date of birth (if you want a birthday treat!) must be provided for a card to be registered. Applicants must be aged 16 or over and must have a resident UK, Channel Island or Isle of Man address. The loyalty program reserves the right to refuse an application at its sole discretion.

b. You will need a valid email address to sign up to our app. If you do not register your app you will not become a member or be able to redeem your points nor will you be eligible for other program offers and promotions from time to time.

c. We will use your email address to administer the loyalty program, communicate our T&Cs and send you information about the current offers. If you don’t want to receive marketing emails, you can unsubscribe at the bottom of the emails. However, by unsubscribing, you won’t be able to see all the great offers available to you without logging in to the app

d. If the loyalty program reasonably believes that you have breached these conditions and/or abused the program, cards may be terminated without prior notice. The loyalty program reserves the right to take any action deemed necessary where a card is found to have been used in a way that abuses the scheme.

e. The loyalty program also reserves the right to: (a) stop issuing the App at any time; (b) on notice to you, alter or amend these conditions of operation of the card and/or scheme; and (c) on notice to you, amend, withdraw or cancel the cards and/or the points (including the value, redemption and issue of such) and/or terminate the scheme. In particular, we may close your account if sufficient points have not been earned to qualify for the issuance of vouchers for 12 months or if the card /app has not been used for a period of 12 months or more.

f. You may terminate your account at any time in which case all points and vouchers issued shall be lost.

g. You are responsible for the security of your app and all vouchers issued. If you believe an unauthorised person has compromised the security of the app by, for example, its theft or the theft of personal information relating to it, you should notify Ruxley Manor immediately. The scheme is not responsible for any unauthorised use of the app or any lost vouchers.

h. Any points issued are personal to the person whose personal details were submitted with their registration. Points are non-transferable, and can only be used by the registered member.

i. We reserve the right to refuse, merge or close additional accounts at any time.

j. Please keep us informed of any changes of address or email address. To update your details, please login to your app and go to the account section.

3. Points and reward vouchers

a. To collect points at Ruxley Manor, you must scan your virtual card at the till at the time of purchase or within 30 days of the date of purchase. In the case of the latter, proof of purchase, using a validated till receipt, will be required for the points to be credited to the app. You cannot claim points on purchases made before you joined the scheme.

b. Points will be awarded on all merchandise sold at Ruxley Manor with the exception of gift vouchers, event tickets, alcohol and gas as well as other products from time to time at our discretion.

c. Product discounts related to, and offered as part of the scheme are not valid for redemption against the excepted merchandise noted in section 3b.

d. You will receive points on qualifying transactions in the centre. The amount of your points will be 1 to every £1 spent. These rates can be altered at the loyalty program’s discretion on reasonable notice. The loyalty program reserves the right to give such notice via post, email or our website. The loyalty program may also display notices detailing any variation to the points earning ratio in-store. The number of points issued may vary between qualifying purchases.

e. The loyalty program reserves the right to offer bonus points on certain products as selected by Ruxley Manor from time to time at its sole discretion.

f. The loyalty program reserves the right to terminate any points offers, including but not limited to such points offers referred to in sections 3e above, at its sole discretion. The scheme will give loyalty program members as much notice as it reasonably can of any decision to terminate or vary any points offers. The loyalty program reserves the right to give such notice via post, email or our website. The loyalty program may also display notices detailing any termination or variation to any points offers in-store.

g. The loyalty program reserves the right to vary the rates at any time on reasonable notice. The loyalty program reserves the right to give such notice via post, email or our website. The loyalty program may also display notices detailing any variation to the points redemption value in-store. All points awarded and all mailing vouchers issued have no monetary value.

h. Several times a year the loyalty program will arrange, either via its own systems or via its outsourced service providers, for you to be sent, via email or the app, your vouchers corresponding to the number of points in your account at that time. The mailing will only contain vouchers if you have a qualifying point balance of £1.00 or more. The loyalty program shall not be responsible for vouchers lost.

i. The loyalty program is entitled to vary the qualifying points balance and the number of mailings a year, from time to time at its sole discretion. The loyalty program will give members as much notice as it reasonably can of any variation to the qualifying points balance and/or the number of mailings a year. The loyalty program reserves the right to give such notice via post, email or our website. The loyalty program may also display notices detailing any variation to the qualifying points balance and/or the number of mailings a year, in-store.

j. When points are redeemed for vouchers carrying a specific cash amount, the voucher will have an expiry date specified on it with a minimum of one month and will be subject to any other terms and conditions stated on the voucher or otherwise publicised.

k. If the loyalty program reasonably suspects abuse, fraud or misconduct in respect of use of the card, it may refuse to issue and/or cancel points or vouchers. You may not rely on any human or software error which results in the award of points or vouchers to which you are not entitled under these conditions.

l. Vouchers are personal to you, non-transferable and cannot be exchanged for cash. They can only be used when presented with the registered card. Vouchers that the scheme deems to be copied will not be accepted.

4. General Terms

a. The scheme may vary these conditions and will give members as much notice as it reasonably can. The scheme reserves the right to give such notice via post, email or our website. The scheme may also display notices detailing any variations to these conditions in-store. Earning further points or using vouchers following such variation shall constitute acceptance of the changes the scheme makes.

b. Members should check our website and specifically these conditions frequently in order to ensure they are aware of any changes that the scheme has made to these conditions.

c. If the scheme decides to transfer the scheme to another legal entity, it may transfer all of its rights and obligations under these conditions without your consent and may disclose information about you to any potential or new owner.

d. The scheme and members rights and obligations under these conditions and any dispute in relation to them shall be governed by English law and heard to the exclusion of all other forums in the English courts. The scheme’s obligations to members in respect of the scheme are contained in these conditions and nowhere else.

e. 10th Hot Drink Free: Loyalty Club members can enjoy a free hot drink after 9 hot drinks have been purchased. You can either scan your loyalty card at the till each time you order a hot drink or order through the app and this will automatically add each hot drink ordered to your ‘free coffee’ card in your Ruxley Manor Gardening Club App. Once 9 hot drinks have been purchased, the 10th one will be free when you order. One free hot drink per Ruxley Manor Gardening Club member served in either The Mulberry Tree Restaurant or Sip & Scoop.

f. Free treat for your birthday: Loyalty members will be rewarded with a free treat in their birthday month. This offer will be valid from the 1st of the month you were born in and will be valid for 31 days. This offer is subject to change and availability.

g. Prize Draws: This reward is a randomised free prize draw throughout the year from all our registered Loyalty Club member purchases excluding the purchase of products highlighted in point 1a. To enter a prize draw ensure you scan your Ruxley Manor Gardening Club App every time you make a purchase in-store. The prize draw winner will be notified and contacted within a week of the prize draw closing date via their marketing communication preferences.

h. Pet Loyalty Club: Loyalty Club members will receive 10% off their 10th purchase from the Pets department. You can scan your loyalty card at the till each time you purchase and this will automatically add each purchase to your Pet Loyalty Club card in your Ruxley Manor Gardening Club App. Once 9 purchases have been made, you will receive 10% off the 10th one.
